Spencer Antle, the founder and creative director of Island Company has released a statement to MTV News saying, “Quit your job. Buy a ticket. Get a tan. Fall in love. Never return is a trademark owned by Island Company since 2005
. This trademark represents the brand and the ideals that lie within. Island Company will remain diligent in protecting it’s brand.”
With great power, comes great responsibility, and even greater lawsuits. Kendall and Kylie Jenner now understand that firsthand thanks to a T-shirt from their PacSun line.
According to legal documents obtained by Daily Business Rewview, Florida-based retailer Island Company has alleged that a saying on one of Kendall and Kylie’s tank tops for their Fall/Winter 2015 collection is a little too close for comfort to their own slogan. Island Company has been using the trademarked “Quit your job. Buy a ticket. Get a tan. Fall in love. Never return.” for its brand since 2005. The PacSun top in question (which is from their southwest-inspired collection and no longer for sale) reads as a sort of abridged version of that: “Run away. Fall in love. Never return.”
Island Company claims that the use of the slogan is “likely to cause confusion, mistake and deception among consumers, the public and the trade as to whether defendants’ products or services are affiliated with, sponsored by or endorsed by plaintiff,” which basically translates to people are going to think Island Company’s merchandise and brand will be affiliated with Kendall and Kylie.
According to Daily Business Review’s report, Island Company has asked that PacSun stop using the phrase, remove all traces of its use (i.e. merchandise, signs, and advertisements) and to pay for damages.
